1. Scope
These terms govern requests for quotation, offers, awards, contracts and delivery tracking in the construction and supply section, between the buyer (an individual, business or owners association) and the provider. They are read with the general terms and the payments, escrow and commission terms.
2. Requests for quotation
- The buyer prepares its request with items, quantities, specifications, files, location and need date. It may set a budget that is shown to providers or kept internal, hide its name until the award, and allow or prevent negotiation.
- A smart agent may analyse the request to suggest how to make it clearer, and the decision rests with the buyer. If the analysis is not complete within the set waiting time, the request is published without it and this is stated.
- Once published, the request's terms are fixed, invitations are added only through their tool, and offers close at the deadline or early for a recorded reason.
- The buyer must make a genuine request with accurate details and must not use the offers for purposes unrelated to the request.
- A request prepared by a visitor without an account is a draft that does not reach providers until the owner of the verified mobile moves it to their account.
3. Offers
- The provider submits its offer with its prices, commercial terms (such as delivery time, warranty and payment) and attachments, and it is saved as a fixed snapshot when submitted.
- An offer does not change after submission except through a change request, and previous versions remain in its history.
- Clarifications and discussion on an offer take place within the Platform, and messages are not edited after sending.
- The provider must ensure the offer is its own and can be performed, and that the specifications and brands stated in it are accurate.
4. Evaluation and award
- Offers are compared using criteria and weights set by the buyer, and a comparison with the price reference or budget may be shown as an alert, not a requirement.
- The buyer may negotiate where allowed, request a "best and final offer" from the shortlist, or cancel a lot or request for a stated reason.
- The award is the buyer's decision alone, and it is not bound to the lowest price or to any offer. A provider not shortlisted is told the general reasons the Platform makes available.
5. The contract
- The contract is created from the awarded lot and fixes its items, prices, schedule and payments; both parties sign it through the Platform.
- A manual contract may be made, or an external contract uploaded for analysis; the parties remain responsible for its content.
- Amendments, annexes, unit prices and measurements are made through their tools with both parties' agreement, are added to the contract history and do not change what was previously signed.
- Compliance alerts or regulatory references may be shown on a contract for guidance; complying with the law is the parties' own duty.
6. Delivery and handover
- The parties follow delivery through defined stages. Entering the review stage is handover of the contract, and a contract is not closed before acceptance.
- The buyer's approval of a stage makes the payments linked to it due under the contract schedule.
- Stoppages and delays are recorded with their reasons and taken into account in due dates.
- The provider is responsible for the safety of its work site and workers and for complying with safety requirements and the building code.
7. Payments
Contract payments are made through the payment gateway in escrow, or through a documented external route if the parties agree, and are subject to commission under the provider's agreement. The external route does not remove the Platform commission due on it. Details of release, holds and refunds are in the payment terms.
8. Disputes
Either party may raise a dispute on the contract or a payment under it in the dispute centre, and amounts in escrow are settled according to its decision, without prejudice to the right to refer the matter to the competent judicial authorities.
9. Not permitted
- Contacting a party to contract outside the Platform on a request sent through it in order to avoid its commission.
- Submitting sham offers or coordinating offers between providers.
- Using the buyer's data or files for anything other than the request.
